Terms of service provision of the portal for clinics and doctors.

General provisions
This document is a public offer of the MEDGID portal, located at https://medgid.kz. The offer is addressed to medical organisations and doctors engaged in private practice on lawful grounds, and contains the terms on which the portal provides services for the placement of information about doctors, clinics and medical services and for the receipt of appointment requests from visitors to the portal. Version dated 10.02.2026.
The following designations are used in the text. Portal — the website medgid.kz together with its auxiliary sections and software. Portal operator, also referred to as the portal — the person who operates the portal and provides services under this offer. Partner — a medical organisation or a doctor in private practice who has accepted the terms of the offer. Card — the page of a doctor, clinic or branch in the portal's catalogue. Request — a visitor's enquiry about booking an appointment, transmitted to the partner. Patient — a visitor to the portal who has submitted a request or a review.
The offer is public: it is addressed to an indefinite circle of medical organisations and doctors and contains the essential terms of a contract for the provision of services for consideration. The relations of the parties are governed by the Civil Code of the Republic of Kazakhstan, the Law of the Republic of Kazakhstan “On Personal Data and Its Protection”, the Law of the Republic of Kazakhstan “On Informatisation”, the Law of the Republic of Kazakhstan “On Advertising” and the legislation of the Republic of Kazakhstan on healthcare, including the Code of the Republic of Kazakhstan “On Public Health and the Healthcare System”.
The portal has the right to amend the terms of the offer. The new version is published on the portal and comes into force from the date named in it, but not earlier than ten calendar days after publication; partners with an existing contract are sent the amendment to the email address named when the contract was concluded. The paid period for the provision of services is completed on the terms of the version in force on the day the invoice was issued. A partner who does not agree with the new version has the right to terminate the contract in accordance with the procedure set out in the section “Term and Procedure for Termination”.

Subject of the offer
The portal provides information services to the partner: it places and maintains the cards of the clinic, its branches and doctors, displays them in the catalogue and search, accepts appointment requests from visitors and transmits them to the partner, and maintains a reviews section with the partner's right to a public reply. The portal does not provide medical care, is not a medical organisation and does not participate in the relationship between the patient and the partner regarding diagnosis and treatment. Medical care is provided by the partner in its own name and under its own licence in accordance with the Code of the Republic of Kazakhstan "On Public Health and the Healthcare System".
The services include: placement of doctors' and clinic cards with a description of services, prices and schedules; initial filling of the cards by the portal based on information from the partner; verification of the institution's licence and the documents of the doctors being placed, following which the card receives the "Verified Clinic" label; acceptance and transmission of requests with notification of the patient about the status of the appointment; maintenance of the reviews section and publication of the partner's replies; a report on the requests received for the billing period; support from an assigned portal employee.
The order of the cards in the results is determined by the sorting selected by the visitor and is not for sale. The portal does not place hidden advertising: advertising placement, if it appears, is marked as advertising and separated from the regular results in accordance with the Law of the Republic of Kazakhstan "On Advertising". The "Verified Clinic" label certifies that the portal has verified the documents and is not an assessment of the quality of medical care.
When accepting a request, the portal transmits to the partner the information necessary for the appointment: the patient's name, their contact details, the selected doctor, the branch, the date and time of the appointment, the type of appointment and the selected service, as well as a comment if the patient left one. The portal does not transmit any other information about the patient to the partner. The link between the patient's contact details and the doctor is stored in the portal's database in encrypted form, and access to it is available only to the portal employee handling the appointment.

Procedure for concluding the contract
The agreement is concluded by acceptance of this offer. Acceptance is deemed to be the performance by the partner of the actions named in this section; from the moment of acceptance the agreement is considered concluded on the terms of the offer in the version in force on the day of acceptance, in accordance with the provisions of the Civil Code of the Republic of Kazakhstan on public offer and acceptance.
The procedure is as follows: the partner leaves an application on the portal page for clinics or sends it to mail@medgid.kz; the portal verifies the institution's licence and the documents of the doctors whose cards are to be placed; the parties agree on the scope of services and the billing period; the portal issues an invoice. Acceptance is the payment of the invoice by the partner. If, by agreement of the parties, placement begins before payment, acceptance is deemed to be the transfer by the partner of information for filling in the cards and the start of their publication.
The partner provides information about its legal status, its licence, its authorised person and its payment details when concluding the agreement. The partner confirms that the person effecting acceptance is authorised to conclude the agreement, and that information about doctors is transferred with the knowledge of those doctors and on a lawful basis.
The agreement is concluded in electronic form. The parties recognise the legal force of documents exchanged by them by email from the addresses named when concluding the agreement, as well as of documents signed with an electronic digital signature in accordance with the legislation of the Republic of Kazakhstan on electronic documents and electronic digital signature. Primary documents are drawn up on paper at the request of either party.
The portal has the right to refuse to conclude the agreement if the licence is not confirmed, if the information about a doctor or clinic is unreliable, or if placement would contravene the legislation of the Republic of Kazakhstan. The payment received in this case is returned to the partner within ten working days.

Cost of services and payment procedure
The cost of services is determined by the portal's tariffs published at https://medgid.kz in the section for clinics and is stated in the invoice. Prices are stated in tenge. The billing period is a calendar month, unless another period is named in the invoice. Services are provided on a prepayment basis: the invoice is issued before the start of the billing period and is paid within five working days from the date of issue.
Payment is made by bank transfer using the payment details named in the invoice. The partner's payment obligation is deemed fulfilled on the day the money is credited to the portal's account. Taxes are assessed and paid by each party in accordance with the tax legislation of the Republic of Kazakhstan; if a party is a value added tax payer, the tax is shown as a separate line in the invoice.
At the end of the billing period, the portal sends the partner an act of services rendered and a report on the requests received. Objections regarding the volume and quality of services are accepted within five working days from the date the act is sent; after this period and in the absence of written objections, the services are deemed accepted.
The portal has the right to change the tariffs. The new tariffs apply to billing periods beginning no earlier than thirty calendar days after publication; the paid period is completed at the previous price. If payment is overdue by more than ten working days, the portal has the right to suspend the display of the partner's cards until payment is received, while preserving their content.
The portal's services for patients are free of charge: no fee is charged to the patient for searching for a doctor, for a request for an appointment or for a review under any circumstances, and the partner may not pass on the cost of the portal's services to the patient as a separate payment.

Rights and obligations of the parties
The Portal undertakes: to place the partner's cards in the agreed scope and to maintain the availability of the Portal; to transmit received requests to the partner without distortion and within a timeframe allowing contact with the patient; to process patients' personal data in accordance with the Law of the Republic of Kazakhstan "On Personal Data and its Protection", storing the link between the patient's and the doctor's contact data in encrypted form; to depersonalise requests upon the expiry of one year from the day of their receipt, retaining depersonalised information about the fact of the appointment itself; to respond to the partner's enquiries within three working days; to publish the partner's response to a review next to that review.
The Portal has the right: to verify the accuracy of information about the partner and doctors and to request supporting documents; to bring the design of cards into the Portal's unified form without changing the factual information; to refuse publication of materials whose rights have not been confirmed by the partner; to suspend the display of cards upon expiry of a licence, discovery of inaccurate information or in the event of justified patient complaints, until the circumstances are clarified, notifying the partner.
The Partner undertakes: to keep information about doctors, services, prices and schedules up to date and to report changes without delay; to process received requests and respond to enquiries from the Portal's booking employee; to hold a valid licence for the declared types of medical activity throughout the entire placement period; to process patients' personal data received from requests solely for arranging appointments and in accordance with the legislation of the Republic of Kazakhstan; not to place on the Portal advertising that contradicts the Law of the Republic of Kazakhstan "On Advertising", including advertising of medicinal products in breach of the established restrictions.
The Partner has the right: to publish a response to any review about itself; to contest a review by sending an enquiry to the Portal — a review whose fact of appointment is not confirmed is removed by the Portal's verification service; to receive a report on requests for the billing period; to demand correction of inaccuracies in the cards. A demand to delete a truthful review containing an assessment of the service received shall not be subject to fulfilment: reviews reflect patients' experience and are removed only on the grounds named in the Portal's rules.

Liability of the parties
The portal is not responsible for the quality and result of medical care, for the diagnosis made, the treatment prescribed, or for the partner's performance of obligations to the patient. This responsibility lies with the partner as the person providing medical care and is determined by the legislation of the Republic of Kazakhstan on healthcare and by the partner's agreement with the patient. The information on the portal is for reference purposes and does not replace a doctor's consultation.
The partner is responsible for the accuracy and completeness of the information provided for publication, for the validity of the licence and the doctors' documents, for the lawfulness of the use of the materials provided, including photographs and texts, and for the compliance of the information provided with the requirements of advertising legislation. If third parties make claims against the portal in connection with information provided by the partner, the partner reimburses the portal for documented expenses.
The portal is responsible for the safekeeping of the data transferred to it and for transmitting requests to the partner in an undistorted form. The portal's liability is limited to the cost of services for the billing period in which the breach occurred. Lost profit is not subject to compensation within the limits permitted by the Civil Code of the Republic of Kazakhstan.
The parties are released from liability for non-performance of obligations caused by force majeure circumstances, of the occurrence of which the party notifies the other party within five working days. Scheduled technical works, of which the portal has given notice at least one day in advance, and short-term interruptions in the portal's availability are not considered a breach.
Each party is independently responsible for the processing of personal data in its own part. In the event of unlawful access to patients' data, the party that becomes aware of such an event notifies the other party immediately and no later than the next working day.

Term and procedure for termination
The offer is valid from the date it comes into force until it is withdrawn by the portal. A contract concluded by acceptance is valid until the end of the paid billing period and is extended for the next period by payment of the next invoice. Withdrawal of the offer does not terminate contracts concluded before the withdrawal: they are performed until the end of the paid period.
The partner has the right to terminate the contract by sending a notice to mail@medgid.kz no later than ten calendar days before the desired date of termination. Payment for unused days of the billing period is refunded proportionally within ten working days from the day of termination of the contract, less the cost of services provided before that day.
The portal has the right to terminate the contract by notifying the partner ten working days in advance, and in the event of the partner's breach of the obligations under the section "Rights and Obligations of the Parties" — after a written demand to remedy the breach and the expiry of ten working days for its remedy. The contract terminates immediately if the partner's licence has expired, the licence has been revoked or suspended, or if the posted information poses a threat to patients' health; in this case, the display of the cards ceases on the day the circumstance is identified.
Upon termination of the contract, the cards are removed from publication within five working days. The partner processes requests received before termination to the end: a patient who has booked an appointment must not be left without an answer. Patient reviews are not deleted upon termination of the contract, since they relate to the service received by patients, and not to the relations between the parties. Patients' personal data remain with the portal for the periods announced in the personal data processing policy, and requests are depersonalised upon the expiry of one year from the day of receipt.
The parties resolve disputes through negotiations. A pre-trial claim is sent by letter and considered within fifteen calendar days from the day of receipt. An unresolved dispute is referred to the court at the location of the defendant; the applicable law is the law of the Republic of Kazakhstan.

Details
The details of the party providing the services are communicated to the partner upon conclusion of the contract and are stated in the invoice and in the act of services rendered: the payment details by which payment is accepted are also named there. Payment is accepted only according to the details named in the invoice; payment details obtained from other sources do not belong to the portal, and payment using them does not discharge contractual obligations.

Applications for the conclusion of a contract, notifications, claims, requests regarding the processing of personal data and demands for the correction of information are sent to this email address. A message sent to the named address is deemed received on the next working day after sending.
The partner communicates its details and contact data upon conclusion of the contract and notifies the portal of any change to them within five working days. The risk of the consequences of not receiving messages sent to the previous data is borne by the party that has not notified of the change.
